1. Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Tidebloom ("we," "our," or "us"), a travel services provider registered in Malaysia, regarding your use of our services and website.
By booking any of our Cappadocia travel experiences, accessing our website, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.
You must be at least 18 years of age to enter into this agreement. If you are booking on behalf of others, you confirm that you have authority to bind them to these Terms.
2. Services Description
Tidebloom provides travel services including hot air balloon flights over Cappadocia, Turkey, and multi-day cultural journeys throughout Turkey. Our services may include:
- Hot air balloon flights coordinated with licensed Turkish balloon operators
- Accommodation arrangements at hotels and cave hotels
- Ground transportation within Turkey
- Guided tours of historical and cultural sites
- Meal arrangements at halal-certified restaurants
- Cultural experiences such as artisan workshops and traditional activities
Service details, itineraries, and inclusions are specified in your booking confirmation. We act as an intermediary between you and third-party service providers (balloon operators, hotels, restaurants, guides) and are not directly responsible for the provision of these services.
3. Booking and Payment
3.1 Booking Process
To book an experience, you must provide accurate personal information including full name (as on passport), contact details, passport information, dietary requirements, and medical conditions relevant to travel safety. All bookings are subject to availability and confirmation.
3.2 Payment Terms
Prices are listed in Malaysian Ringgit (MYR) and include all services specified in the itinerary. Payment is required as follows:
- A 30% deposit is due upon booking confirmation
- Full payment is due 60 days before departure date
- Bookings made within 60 days of departure require full payment immediately
We accept payment via bank transfer, credit card (Visa, Mastercard), and other methods as specified during booking. All transactions are processed securely through PCI-DSS compliant systems.
3.3 Price Validity
Prices are valid at the time of booking and may change without notice. Once a booking is confirmed and deposit paid, the price is locked for that reservation.
4. Cancellations and Refunds
4.1 Client Cancellations
If you need to cancel your booking, the following cancellation fees apply:
- More than 60 days before departure: 10% of total booking value
- 30-60 days before departure: 50% of total booking value
- 15-29 days before departure: 75% of total booking value
- Less than 15 days before departure: 100% of total booking value (no refund)
Cancellations must be submitted in writing to [email protected]. Refunds will be processed within 30 business days.
4.2 Weather-Related Cancellations
Hot air balloon flights are weather-dependent and subject to cancellation by the balloon operator for safety reasons. If your balloon flight is cancelled due to weather:
- We will attempt to reschedule for the next available morning during your stay
- If rescheduling is not possible, a full refund for the balloon flight portion will be provided
- No compensation is provided for related costs (accommodation, meals, transport) already incurred
4.3 Tidebloom Cancellations
We reserve the right to cancel any booking due to insufficient participant numbers, force majeure events, or safety concerns. In such cases, you will receive a full refund or alternative dates if available.
5. Travel Documents and Insurance
5.1 Travel Documents
You are responsible for obtaining all necessary travel documents including valid passport (minimum 6 months validity from travel date), Turkish e-Visa or visa, and any health certificates required. We can provide guidance but are not responsible for your failure to obtain proper documentation.
5.2 Travel Insurance
We strongly recommend obtaining comprehensive travel insurance covering medical expenses, trip cancellation, baggage loss, and emergency evacuation. Tidebloom is not liable for expenses arising from medical emergencies, trip interruptions, or lost belongings.
6. Health and Safety
6.1 Medical Conditions
You must disclose any medical conditions, disabilities, or dietary restrictions that may affect your ability to participate in activities. Certain conditions may preclude participation in balloon flights, including pregnancy, recent surgery, severe heart conditions, or inability to stand for extended periods.
6.2 Safety Compliance
You agree to follow all safety instructions provided by guides, balloon pilots, and activity coordinators. Failure to comply may result in removal from activities without refund. Hot air balloon flights are subject to weight restrictions and age requirements as determined by the balloon operator.
6.3 Assumption of Risk
You acknowledge that travel, including hot air balloon flights, involves inherent risks. By participating, you voluntarily assume these risks and agree not to hold Tidebloom liable for injuries or accidents resulting from activities.
7. Client Responsibilities
As a client, you agree to:
- Arrive on time for all scheduled activities and transport
- Treat guides, service providers, and other travelers with respect
- Comply with local laws, customs, and cultural norms in Turkey
- Respect heritage sites and follow photography restrictions where posted
- Not engage in behavior that endangers yourself or others
- Report any issues or concerns to your guide or Tidebloom immediately
8. Changes to Itinerary
While we make every effort to adhere to published itineraries, we reserve the right to make changes due to weather, local conditions, transportation issues, or force majeure events. We will inform you of significant changes as soon as possible and provide suitable alternatives when available.
Minor changes to timing, accommodation, or activity order do not constitute breach of contract and do not entitle you to compensation or refund.
9. Limitation of Liability
Tidebloom acts as an intermediary between you and third-party service providers. We are not liable for:
- Acts or omissions of third-party service providers (hotels, balloon operators, restaurants, guides)
- Loss, damage, or theft of personal belongings
- Injuries, illnesses, or accidents during activities
- Delays or cancellations due to weather, transportation issues, or force majeure
- Failure to obtain necessary travel documents or entry to Turkey
Our total liability for any claim arising from your booking is limited to the total amount paid for the booking. We are not liable for indirect, consequential, or punitive damages.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence or for fraud.
10. Intellectual Property
All content on our website, including text, images, logos, itineraries, and design, is the property of Tidebloom or our licensors and is protected by copyright and trademark laws.
You may view and print content for personal use only. You may not reproduce, distribute, modify, or create derivative works without our written permission.
11. Privacy and Data Protection
Your personal data is processed in accordance with our Privacy Policy. By using our services, you consent to the collection, use, and sharing of your data as described in the Privacy Policy.
12. Force Majeure
We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, government actions, pandemics, strikes, or other force majeure events.
In such cases, we will make reasonable efforts to provide alternative arrangements or refunds where feasible.
13. Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of Malaysia. Any disputes arising from these Terms or your booking will be subject to the exclusive jurisdiction of Malaysian courts.
13.2 Informal Resolution
Before initiating formal legal proceedings, you agree to attempt to resolve disputes through good-faith negotiations. Contact us at [email protected] with details of your concern.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
15. Entire Agreement
These Terms, together with your booking confirmation and our Privacy Policy, constitute the entire agreement between you and Tidebloom regarding your booking and supersede all prior communications or agreements.
16. Changes to Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business operations. Updated Terms will be posted on our website with a new "Last Updated" date.
Bookings made before a change in Terms will be governed by the Terms in effect at the time of booking. New bookings are subject to the current Terms.
